Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the BKOS platform and any related services, content, or community features (collectively, the "Service") operated by The Successful Bookkeeper Global Inc., doing business as BKOS ("BKOS," "we," "our," or "us").

By creating an account, accessing the Service, or clicking "I agree," you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About BKOS

BKOS is a practice-management operating system for bookkeeping professionals. The Service includes workflow tools, community features, training content, templates, and integrations provided through the BKOS platform at bkos.io and community.thesuccessfulbookkeeper.com.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract in your jurisdiction to use the Service. By using BKOS, you represent that you meet these requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information when registering;
  • Notify us immediately of any unauthorized use of your account;
  • Not share your login credentials with any third party.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Permitted Use

You may use the Service solely for your own legitimate business purposes as a bookkeeping professional or as permitted by your organization's subscription. You agree not to:

  • Reproduce, distribute, or resell any BKOS content or materials without our written permission;
  • Use the Service to develop competing products or services;
  • Reverse engineer, decompile, or attempt to extract source code from the platform;
  • Transmit harmful, unlawful, harassing, defamatory, or otherwise objectionable content;
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure;
  • Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service.

5. Intellectual Property

All content on the Service — including training materials, templates, workflows, written content, video, audio, graphics, and the BKOS software itself — is owned by or licensed to The Successful Bookkeeper Global Inc. and is protected by applicable copyright, trademark, and intellectual property laws.

Nothing in these Terms grants you ownership of any BKOS content. Your subscription gives you a limited, non-exclusive, non-transferable right to access and use the content for your own internal professional purposes.

Content originally created for The Successful Bookkeeper or Pure Bookkeeping programs, where incorporated into BKOS, remains the intellectual property of The Successful Bookkeeper Global Inc.

6. User Content

Where the Service allows you to post, share, or submit content (messages, comments, files, etc.), you retain ownership of that content. By submitting it, you grant The Successful Bookkeeper Global Inc. a non-exclusive, royalty-free, worldwide licence to use, store, display, and transmit that content as necessary to operate the Service.

You are solely responsible for the accuracy, legality, and appropriateness of any content you submit.

7. Subscriptions and Payment

Access to certain features of the Service requires a paid subscription. Subscription terms, pricing, and billing cycles are set out at the time of purchase and may be updated with notice.

  • Subscriptions are billed in advance on a recurring basis unless otherwise stated;
  • All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy;
  • We reserve the right to change pricing with at least 30 days' written notice. Continued use after a price change constitutes acceptance.

8. Cancellation and Termination

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Access to the Service continues until the end of the paid period.

We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees.

9. Third-Party Services and Integrations

The Service may integrate with or link to third-party tools and platforms. These integrations are provided as a convenience; we do not control third-party services and are not responsible for their availability, accuracy, or practices. Your use of third-party services is governed by those parties' own terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not provide legal, accounting, tax, or financial advice; nothing in the Service constitutes professional advice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SUCCESSFUL BOOKKEEPER GLOBAL INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless The Successful Bookkeeper Global Inc. and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Ontario, Canada under the rules of ADR Chambers. If you are a consumer in a jurisdiction that does not permit mandatory arbitration, you may have additional rights under local law.

14. International Use

The Service is operated from Canada. If you access the Service from outside Canada, you do so at your own initiative and are responsible for compliance with local laws.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service at least 14 days before changes take effect. Continued use after the effective date constitutes your acceptance of the revised Terms.
